Driving Offences: Impaired Driving and Over 80

The maximum legal limit for fully licensed drivers in Ontario and in Canada is 80 milligrams of alcohol in 100 milliliters of blood (also known as Over 80). Both the offence of Over 80 and the various defences which may exist are very technical and require the skill and expertise of an experienced lawyer.

Impaired driving occurs when an individual operates a motor vehicle while his/her ability to operate the motor vehicle is impaired (by drugs or alcohol) to any degree. It is important to note that an individual can be charged with Impaired care and control of a motor vehicle as well.

The consequences are serious. You may:

  • lose your licence
  • have your vehicle impounded
  • need to attend an education or treatment program
  • be fined upon conviction
  • be required to install an ignition interlock device in your vehicle
  • spend time in jail
  • end up with a criminal record

 

For a first time offender, a finding of guilt (whether it is upon a guilty plea or after a trial) leads to mandatory minimum punishments, including a $1,000 fine and a one year driving prohibition. It is important to consult an experienced impaired driving and over 80 lawyer as soon as possible.
